Determine Eligibility for Arbitration

  • Arbitration is available for property types such as:
    • Residential properties with a market value of $5 million or less, except for residential homesteads for which there is no value limit.
    • Commercial properties with a market value of $5 million or less.
  • The dispute must involve the market value or unequal appraisal of the property.
  • Binding arbitration cannot be pursued if you have already filed a lawsuit over the same issue.

Filing the Arbitration Request

  • Deadline: The request for arbitration must be filed within 60 days of receiving the ARB’s written order of determination.
  • Submit Request: Submit the request for arbitration online through the comptrollers Property Tax Arbitration System.
  • Filing Fee: Upon submission you must pay the required deposit.
    • Deposit amounts range from $450 to $1,500 and is computed based on the property value and whether there is a homestead exemption.
  • Settlement Period: Once the request has been processed, the case will enter a 45-day settlement period.
    • This time can be used to negotiate a settlement with the appraisal district.
